Legally in the city of Oakland, if you’re covered by Oakland’s Rent Ordinance, your landlord is obligated to serve you a RAP notice with your lease 6 months prior to any rent increase. If they don’t, you have 120 days to file a petition with the Rent Adjustment Program. If they have never given you a notice, you can file a petition whenever you realize this is an option for you. This will pause the rent increase and will provide you a hearing within a few months to figure out if the rent increase holds validity.
